E-SIGN Disclosure and Consent
Please read this Disclosure and Consent carefully and keep a copy for your records.
By consenting to this E-SIGN Disclosure and Consent (“E-SIGN Consent”), you are agreeing to the use of electronic records and electronic signatures in your relationship and transactions with Comerica Bank® (“Comerica,” “we,” “us,” “our”). This E-SIGN Consent contains information you should review before providing your consent, including the types of communications that may be sent and signed electronically, how to obtain paper copies, hardware and software requirements for electronic communications, and how to withdraw your consent if you later decide you no longer want to receive records from us electronically.
Scope of Consent. This E-SIGN Consent applies to all communications, agreements, notices, documents, and disclosures related to the accounts, products and services you have with Comerica now or in the future, including but not limited to periodic statements, authorizations, fee schedules, tax forms and reports, responses to claims, notices or communications about the terms of your agreements with us and any amendments, and privacy policies and notices (“Communications”). Communications may be provided or made available electronically via email or SMS text message, downloaded via Portable Document Format (PDF), posted on a secure website, or through one of our online platforms, such as Comerica Web Banking or Mobile Banking. It is your responsibility to print or download these Communications if you wish to maintain a copy for your records.
By consenting to this E-SIGN Consent, you may not be automatically enrolled to receive all Communications electronically. You may still need to set your preferences to receive certain types of Communications in electronic format. If you set your delivery preferences to paper format, it does not constitute a withdrawal of your consent to receive electronic records and use electronic signatures nor does it terminate this E-SIGN Consent. To withdraw your consent to receive Communications electronically, you must follow the instructions set forth in the section titled "Withdrawal of Consent" below.
Paper Copies of Communications. You may request a paper copy of any Communication by calling us at 800-266-3742. We may charge you a reasonable fee for sending paper copies of Communications (refer to your account agreement or fee schedule). Requesting a paper copy of a Communication will not withdraw your consent to receive Communications electronically. We may, in our sole discretion, deliver any Communications on paper even if you have consented to electronic delivery. We may also require that you provide certain communications to us on paper.
Hardware and Software Requirements. To access, view, print or retain electronic Communications, you must have the following equipment and software:
- Access to a personal computer or other device capable of accessing the Internet, or downloading our mobile apps with the most current version (or the version released just prior to) of (i) an operating system, such as Windows, Mac OS, iOS or Android, and (ii) an internet browser, such as Edge, Safari, Firefox, or Chrome, that supports 256-Bit encryption and JavaScript, including any available security updates to ensure a maximum encryption
- A connection to the internet
- Software that permits you to receive and access files in HTML or PDF format, such as a current version of Adobe Acrobat Reader
- A printer to print and/or a computer or other data storage unit to retain the electronic Communications
- An active email account
Changes to Your Email Address. You represent that any email address you provide to us belongs to you or a person who has authority to act with respect to your Comerica accounts, products and services and you agree that any Communications delivered to that email address will constitute delivery to all account owners. To notify us of changes to your email address, call us at 800-266-3742.
Withdrawal of Consent. To withdraw your consent for electronic Communications, write to Comerica Bank, Customer Service Center, P.O. Box 75000, Detroit, MI 48275. Your withdrawal of consent will be effective only after we have received your request and had a reasonable opportunity to act upon it. Please note that withdrawing consent may result in the termination of your access to Comerica Web Banking and Mobile Banking and other Comerica products and services.
Consent. By providing your consent:
- You acknowledge you have read and understand this E-SIGN Consent and you consent to receive Communications electronically and to use electronic signatures.
- You confirm you have the hardware and software required to view Communications electronically and you are able to receive and review electronic documents.
- You confirm you have provided us with a current email address and you will notify us promptly if your email address changes.
- You confirm you are an owner or other authorized individual with respect to your Comerica accounts, products and services and only your consent is required to receive Communications electronically and use electronic signatures.
- You agree that this E-SIGN Consent is provided in connection with a transaction affecting interstate commerce and is subject to the federal Electronic Signatures in Global and National Commerce Act, which we both intend to apply to the fullest extent permitted by law.
